In accordance with the General Data Protection Regulation (GDPR), Stichting Sonic Acts (otherwise referred to as ‘we’, ‘us’ or ‘our’) is authorised to process your personal data because you make use of our services and/or because you have provided us with the data by filling in a form on our website. As our guiding privacy principal, we don’t ask you for any personal information unless we truly need it.
Personal data refers to all information that relates to an identified or identifiable living individual. Depending on the situation, we process one or more of the following categories of personal data:
- Basic information such as your title, name and surname;
- Contact information such as your an email address, postal address and telephone number
- Information about the device you use to visit our website, such as your IP address, internet browser and device type.
- Personal data that you provide us with in the context of attending any gatherings or events;
- Personal data that you provide us with in connection with a job/residency or open call application, such as your first and last name, date of birth, address, telephone number, nationality, marital status and any other personal data mentioned in your application;
Processing refers to any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
Sensitive Data
If you are younger than sixteen years old, you cannot use our website and/or services without the permission of your parents or legal guardian. However, we cannot check whether a visitor is older than 16. We therefore advise parents to be involved in the online activities of their children, to prevent data about children being collected without parental consent.
Personal Information
It’s probably no surprise that we collect information that you provide to us directly. In the below text we explain how each category of information is dealt with. We process your personal data for the following purposes:
- Payment information and associated contact information. For example, if you buy something from us.
- Sending newsletters and invitations for events and openings
- Sending press releases (when you are listed in our press database)
- Forms, emails and customer relations management. For example, if you send us an email.
- To be able to send you certain goods or services that you requested
- Content information. For example, you might provide us with information about you if you submit a draft or/and project proposal.
- To recruit, hire or commission
- When we are legally obligated to, for instance, data we need in order to complete our tax returns.
Website Visitors
Our website is hosted by Hostnet B.V. in The Netherlands. Like most website operators, we process your IP address, as well as non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request to deliver a user-friendly, informative and relevant environment.
We also use ‘cookies’, although we aim to use as few as possible. Cookies are text files which are stored temporarily or permanently on your computer to identify you as a recurring visitor. We process this usage statistics gathered from the cookies insofar this is necessary for our legitimate interest to analyse the use and functioning of this website. We use a few different content management systems across our websites. A custom-built content management system, that we only operate the software ourselves and run it on our own servers. We have a DPA agreement with Craft CMS, their privacy policy is accessible here. And we also make use of Strapi CMS, their privacy policy is accessible here.
This website also deploys content and services offered from third-party providers, to do things like integrate videos and other content, for instance. Service providers you’re likely to encounter on these pages are Facebook, Instagram, X, YouTube, Vimeo, SoundCloud, amongst others. The listing links to their respective privacy policies.
This website uses Google Analytics, which places analytical cookies to record your site use and stores data about it (including your IP address) on servers in the USA. It uses this data to create statistics for website administrators and to offer other services. Google provides this data to third parties if required by law or if these third parties process the data on behalf of Google. Google does not combine your IP address with other data that it has. By using this website you consent to this data processing by Google. You can use the developer tools of your browser to see the local data stored by this website. It is generally a good habit to take a look at this every now and then anyway. You can use the settings within your browser to control the cookies that are set on your computer. Shopping
When you make a purchase through the Sonic Acts Shop, you will be asked to provide data to fulfil the agreement, including the delivery of the product. This information is processed by WooCommerce, their privacy policy is accessible here. Payments in the shop go through iDeal or PayPal. WooCommerce does not process bank details. We collect information about the transaction, such as product details, purchase price, and the date and location of the transaction in accordance with tax obligations.
Forms, E-mails, and Customer Relations
If you send us an email (@sonicacts.com), the related personal data will be stored and processed for as long as is necessary, depending on the purpose of the form or the contents of your email, for it to be answered or processed properly. In addition, we may store emails we receive if this is necessary for us to properly carry out our regular activities. We use Plesk software. We only operate the software ourselves and run it on our own servers. Our contacts’ email addresses may also be stored locally in the personal address books of Sonic Acts employees. If requested, we can remove your contact information from our systems entirely.
Data Retention
We will keep your personal data only for the period necessary to fulfil the purposes for which it was collected or processed:
- Marketing data (for instance, the newsletter): after you unsubscribe, we save this data for a maximum of 2 years.
- Administrative data (like invoices, receipts, etc.): we are legally obligated to save the data for 7 years.
- Applications: If you are selected, the information related to your job/residency or open call application will end up in your personnel file. If you are not selected, we will keep your personal data until four weeks after you’ve been rejected, unless you provide consent for us to keep it for a longer time, e.g. to be included in a talent pool.
Rights
The GDPR gives you various rights concerning your personal data. These rights include:
- Right of access. You may submit to us free of charge a request for information about the processing of your personal data.
- Right to rectification. At your request we will correct or add to your personal data if these are incorrect or incomplete, taking account of purpose of the processing.
- Right to erasure. Where one of the grounds of Article 17 of the GDPR applies, we will erase your personal data without undue delay.
- Right to withdraw your consent. You may withdraw your consent to the processing of your personal data at any time.
- Right to object. You have the right to object to the processing of your personal data if the processing is based on the legal ground of our legitimate interest.
- Right to restriction. You have the right to obtain from us a restriction of processing of your personal data. This right may be exercised if one of the elements of Article 18 of the GDPR applies. The consequence of this is that your personal data will (temporarily) not be processed or changed.
- Right to data portability. You have the right to receive your personal data from us in a structured, commonly used and machine-readable format and to transfer them to another controller.
- Right to submit a complaint. You have the right to submit a complaint to the Dutch Data Protection Authority if you are of the opinion that your personal data are being processed in contravention of this privacy statement.
You can exercise your rights by sending an email or letter to us with your request; use the contact details listed above. To comply with your request, we might ask you to provide information to verify your identity. Third Parties
We will never pass on your personal data to third parties, with the exception of the cases explicitly mentioned in the contents of our privacy statement. The only two exceptions to the rule are:
- If we have explicitly asked for your permission in advance, prior to passing on your personal data to third parties;
- If we are legally required to do so, and only after we have tried our very best to prevent having to pass on your data on the basis of a legal obligation.
Privacy Policy Changes
Although most changes are likely to be minor, Sonic Acts may change its Privacy Statement from time to time, and in Sonic Acts’ sole discretion. If we change something important, we’ll announce that on our website. By continuing to access our Website, you agree to be bound by the revised statement.
